NOTICE OF WORKSHOP TO SOLICIT COMMENTS ON PROPOSED CHANGES TO EXISTING REGULATIONS AND POTENTIAL REMOVAL OF EXISTING REGULATIONS
This Notice also serves as notice for the purposes of the Open Meeting Law, NRS 241.020
Pursuant to Governor Lombardo’s Executive Order No. 2023-003, the Nevada Department of Transportation (“NDOT or Department”) is proposing to remove an existing regulation from the Nevada Administrative Code, Chapter 408.
A workshop has been set for Thursday, June 13, 2024 at 9:00 a.m.

The purpose of this workshop is to solicit comments from interested persons regarding the removal of Department regulations and specifically removal of the following regulation, NAC 408.796(2).
NAC 408.796 Period of acceptance; ranking; fee authorized in certain circumstances. (NRS 408.215, 408.557, 410.400)
1. If the Department desires to place business signs on a new panel, the Department or its contractor will do the following:
(a) Accept applications for a period of 30 days after the date specified by the Department or contractor.
(b) If the number of applications received within the 30-day period exceeds the maximum number of available spaces for business signs on any single panel, base the order of ranking on the proximity of each qualified business to the interchange, giving preference to the qualified business located closest to the terminus of the off ramp.
2. [When six or more qualified businesses apply to display a business sign for an attraction on a panel, the Department or its contractor may establish a fee applicable to the specific area where the business sign will be displayed which reflects the market value for a sign in that area.
3.] As used in this section, “contractor” means a person who enters into a contract with the Department to administer a program for erecting signs for specific services or activities as authorized by the Department’s Manual on Uniform Traffic Control Devices.

Persons wishing to comment on the proposed action of the Department may provide their comments, data, views, or arguments, in written form to the Department. Written submissions must be received by the Department on or before June 12, 2024.

- Pursuant to Governor Lombardo’s Executive Order No. 2023-003, the Department is proposing to modify an existing regulation and potentially remove a portion thereof, specifically NAC 408.796(2). Consequently, this is a workshop to allow: (1) the industry stakeholders’ and public’s response to the proposed deleted language of the identified regulation.
- Public Comment – Members of the public are invited to comment on items on the meeting agenda or on items not contained therein. No action may be taken on a matter raised during public comment until the matter itself has been specifically included on an agenda as an item for possible action.
- Adjournment – In accordance with Nevada’s Open Meeting Law, the Department may consider agenda items taken out of order. The Department may combine two or more agenda items for consideration. The Department may remove an item from the agenda or delay discussion relating to an item on the agenda at any time. The Department may continue the meeting as deemed necessary.
The Department, at its discretion, may take public comment during times other than the designated Public Comment agenda items. The Department reserves the right to limit public comment to three minutes. Comment may not be restricted based on viewpoint.
