The Dispute Resolution Program is a tool to assist stakeholders on NDOT projects to resolve disputes at the lowest level possible. When disputes cannot be resolved through the partnering process and by utilization of the project Issue Resolution Ladder, NDOT may use Dispute Review Teams (DRTs) as a resource to make recommendations as to the merits of an issue to assist the Department and Contractor to resolve issues at the project level. Unresolved disputes often turn into claims at the end of a project sometimes resulting in costly and time consuming litigation and compromised relationships. The decision to implement a DRT on any one project will be based upon project scope, cost, duration and complexity.
When it is determined that a DRT will be utilized on an NDOT Project, NDOT will implement the revised Section 105.18 Disputes Review Team Specification in the project Special Provisions. A Three-Party Agreement must be signed at the DRT kick-off meeting for the project at which time NDOT, the Contractor and the DRT will collaborate on the processes and guidelines that will be in place for the DRT on that specific project. NDOT has developed Sample DRT Procedures and Guidelines that may be modified at the kick-off meeting and incorporated into the Three-Party Agreement.
